These Terms of Use (these “Terms”) set out the conditions for using Hello Jazz, an app for iPhone (the “App”), provided by Hello Jazz Academy (“we” or “us”). You shall use the App only after agreeing to these Terms.
Article 1 (The App)
The App is a learning app for studying jazz theory, rhythm, improvisation, and solfège by answering questions. The lessons, questions, and explanations in the App are provided as a reference for learning. If you use them to make decisions about performances, examinations, or the like, please also check them yourself.
Article 2 (Relationship with Apple’s Terms)
Your acquisition and use of the App are subject to the App Store terms and conditions set by Apple and to Apple’s standard license agreement (the Licensed Application End User License Agreement). In addition to those, these Terms set out the conditions between you and us for your use of the App. We, not Apple, respond to any inquiries or complaints about the App and its content.
Article 3 (Fees)
The App is free to download and use. VIP under Article 5 is a paid service. You are responsible for any data charges required to use the App.
Article 4 (Lives, Swing Points, and the Like)
- Lives, Swing Points (SP), tickets, levels, and streaks (collectively, “In-App Items”) are features that exist only within the App and are earned by progressing through your learning in the App.
- In-App Items cannot be purchased with money and have no monetary value. They cannot be exchanged for cash or anything else, transferred to other users, or refunded.
- The number of In-App Items, the time it takes for Lives to recover, the SP required for exchanges, and the like may change with updates to the App.
- In-App Items and your learning records are stored on your device. They may not be carried over if you delete the App or change devices.
Article 5 (VIP)
- VIP is an auto-renewable subscription on the App Store. While you subscribe to VIP, you receive the benefits shown on the VIP screen in the App: No Ads (「広告なし」), with no ads shown after lessons, and Unlimited Lives (「ライフ無限」), with no Lives lost.
- The plans and prices are as follows. The price is the amount shown on the purchase screen and in the App Store (outside Japan, the amount is in the currency of your region).
Plan Period Price (JPY) VIP Annual Plan Renews automatically every year ¥3,600 per year (¥300 per month) VIP Monthly Plan Renews automatically every month ¥500 per month - If you subscribe to VIP for the first time, you can try it with a 7-day free trial (whether you are eligible is shown on the purchase screen). When the free trial ends, you will be charged the price of the plan you chose. To stop without being charged, cancel at least 24 hours before the free trial ends. If you cancel during the free trial, you cannot receive the free trial again.
- Payment will be charged to your Apple Account at confirmation of purchase (or, if there is a free trial, when the free trial ends).
- VIP automatically renews for the same period at the end of each period unless it is canceled. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period. To stop the renewal, cancel at least 24 hours before the end of the current period. If the price increases, Apple will notify you and, if required, ask for your consent to continue.
- You can view, change, and cancel VIP on your iPhone in Settings > [your name] > Subscriptions. Once canceled, VIP will not renew for the next period.
- If you reinstall the App or change devices, you can restore VIP purchased with the same Apple Account by tapping Restore Purchases (「購入を復元」) on the VIP screen.
- Payments and refunds are processed by Apple. We are unable to process refunds. Please direct any refund requests to Apple.
Article 6 (Use by Minors)
If you are a minor, please obtain the consent of a parent or guardian before using the App, and in particular before purchasing VIP. Kids Mode (「キッズモード」) in the App is a display option that shows music terms with their readings in hiragana.
Article 7 (Rights)
The rights to the lessons, questions, explanations, figures, sounds, illustrations, character (Pappy), and other content of the App belong to us or to their rightful holders. The sound sources, software, and fonts that the App uses are used under their respective licenses, which are shown under Sound Licenses (「音源のライセンス」) and Software Licenses (「ソフトウェアのライセンス」) in Help & Information (「ヘルプと情報」) on the App’s My Page (「マイページ」).
Article 8 (Prohibited Conduct)
When using the App, you must not engage in any of the following conduct.
- Conduct that violates laws or regulations or is contrary to public order and morals
- Copying, reproducing, or redistributing the content of the App without the permission of the rights holder
- Modifying the App or analyzing it, such as by reverse engineering (except as permitted by law)
- Conduct that interferes with the operation of the App or with other users
Article 9 (Changes to the Content; Discontinuation)
We may change or add to the lessons, questions, and features of the App and the number of In-App Items without notice. We may also discontinue all or part of the App when unavoidable circumstances arise.
Article 10 (Disclaimer)
- We strive to keep the content of the App accurate, but we do not guarantee that the content is accurate or that it fits any particular purpose of yours.
- Except in cases of our willful misconduct or gross negligence, we are not liable for any damage you incur from using the App. However, this does not apply where our liability cannot be excluded under the Consumer Contract Act of Japan or other laws and regulations.
Article 11 (Changes to These Terms)
We may change these Terms as necessary. If we change them, we will announce the revised Terms and the date on which they take effect on this website in advance. If you use the App after that effective date, you will be deemed to have agreed to the revised Terms.
Article 12 (Governing Law and Jurisdiction)
These Terms and the relationship between you and us concerning the App are governed by the laws of Japan. If a dispute arises between you and us concerning the App, the Nagoya District Court shall have exclusive jurisdiction by agreement as the court of first instance.
